JOB PURPOSE:
- Manage the overall corporate compliances and tax advisory for MISC Group.; including but not limited to tax advisory, monitoring tax payment, tax audit, transfer pricing etc. for the purpose of minimising tax liability and optimising tax benefits.
- Provide appropriate tax advice relating to MISC Group’s domestic andinternational tax strategy, coordinating external advice as necessary to create and maintain an optimum tax structure and minimising the Group’s direct tax cost and exposure.
- Engage with the business to support the activities relating to MISC Group’s domestic and international tax strategy and transfer pricing model.
- Act as a business partner for MISC group subsidiaries, managing all direct tax matters.
- Ensure all global tax compliance obligations are met and tax returns are consistent with planning structures in place.
PRINCIPAL ACCOUNTABILITIES:
Tax Compliance & Regulations
- Manage and review corporate tax filing plan the Group to ensure timely submission of annual tax returns across MISC Group.
- Manage the Local and Global Group Transfer Pricing model and manage any associated risks
- Manage analysis of changes in tax laws and regulations to ensure tax considerations are appropriately addressed and integrated and proactively recommend changes to internal processes or strategies as needed.
- Manage and review of tax returns & documentations and transfer pricing documentations prepared by Service provider/ in-house and tax queries/issues raised by internal stakeholders and external party.
- Manage and review corporate tax audits request by internal or external parties.
- Identify improvement opportunities to the tax compliance process and implement related process changes.
Tax planning/ optimization
- Recommend optimum strategies on corporate tax matters for the Group such as tax planning opportunities, managing transfer pricing risk, avail for tax incentives/ exemption, etc. across MISC Group
- Perform analysis of financial data to identify tax planning opportunities, including evaluating the tax implications of various business decisions and identifying areas for tax savings.
- Assess implications of new tax rulings and legislations and provide recommendations for
- Groupwide applications (e.g. Global Minimum Tax)
Tax advisory & consultancy
- Liaise with cross-functional teams to provide tax input on key business initiatives such as mergers and acquisitions, divestitures, and strategic investments.
- Provide ad-hoc advice on corporate tax-related matters covering requests by management and authorities.
- Participate in cross-functional projects and initiatives to ensure tax considerations are appropriately addressed and integrated into business decisions.
- Participate and provide specialized tax advice on projects, covering:
o Project structure
o Withholding tax
o Transfer pricing
o RPGT
o Stamp duty
o Global Minimum Tax (GMT)
o Corporate exercises (e.g. M&A, joint ventures, restructuring, financing, etc.)
o Tax incentives/ exemptions etc
Tax Governance
- Manage overall compliance with related tax governance imposed by authorities such as Bursa, IRB, Ministry of Finance, etc
- Manage processes, framework and controls and ensure all are in place to manage and mitigate tax risks including periodic reviews for further enhancement.
- Maintain comprehensive tax impacted and end-to-end business process flows and internal controls for control improvements.
Periodic Health Check
- Manage on-site tax risk assessments and assess and present report findings with action required to relevant parties.
- Collaborate with other departments where relevant to direct non-compliance tax issues noted to appropriate channels for investigation and resolution.
Tax Business Partnering
- Act as a business partner to the business units by recommending guidance and industry-insights (e.g. exemptions and incentives) through collaboration with senior Finance and Business stakeholders to drive value creation.
- Act as a country focal person for all direct tax matters by recommending Group concise advice and strategic perspectives by keeping abreast with evolving country specific tax laws to manage risk exposure and future business expansions.
Group Tax Knowledge Sharing/ Awareness sessions
- Manage and participate in continuous knowledge awareness sessions for the Group on direct tax matters.
- Provide updates on new laws / rulings / precedents / case laws, etc. to ensure compliance and to increase awareness.
Networking and Relationship Building
- Establish and maintain networks and relationships with the tax authorities and other relevant government agencies, tax consultants and subject matter experts to develop alliances or expand tax-related knowledge.
- Act as focal person for both internal and external parties.
REQUIREMENT & QUALIFICATION:
- Minimum 10 years working experience with at least 9 years of working experience in corporate taxation function. Exposure to indirect and international taxes would be an added advantage.
- Exposure in managerial capacity/position and possess a working appreciation of the role and orientation of the top management.
- Degree in Accounting/Finance/ Business or equivalent.
- A member of ACCA/ICAEW/CTIM would be an added advantage
